WALRUS is a professional field screening aid. It is not a laboratory analysis and does not establish cylinder contents, composition, purity, safety, or compliance. Your use is subject to the limitations described on the Safety & Limitations page.
01Agreement
These Terms of Use govern your use of the WALRUS mobile application and this website (collectively, the “Service”), provided by Phoenix Strategies LLC (“Phoenix Strategies,” “we,” “us”). By downloading, accessing, or using the Service, you agree to these terms. If you do not agree, do not use the Service.
02Professional use and responsibility
The Service is intended for qualified HVAC/R technicians. You are responsible for your work, your equipment, the conditions in which you use the Service, and compliance with all applicable law, regulation, manufacturer instructions, safety data sheets, workplace procedures, and environmental requirements. Do not use the Service for emergency, life-safety, exposure, or hazard-response decisions.
03Limitations and no reliance for critical decisions
Results are generated from user-entered data and bundled models. They are subject to limitations including, without limitation, instrument accuracy and calibration, pressure basis, atmospheric conditions and altitude, cylinder stabilization, liquid-vapor state, blends, contamination, moisture, oil, air, non-condensables, unsupported refrigerants, and model limits. You must independently verify any information before using it in a decision involving safety, handling, charging, recovery, reclamation, reuse, resale, disposal, compliance, or environmental impact.
04No professional advice
The Service does not provide legal, engineering, safety, environmental, medical, or professional advice. It does not replace a qualified laboratory, refrigerant analyzer, manufacturer, regulator, safety professional, or other qualified expert.
05Permitted use
You may use the Service for its intended professional screening purpose. You may not misuse the Service, interfere with its operation, attempt unauthorized access to its systems, or use the optional feedback feature to submit unlawful, harmful, deceptive, confidential, or infringing material.
06Feedback
If you submit feedback, you confirm that you have the right to submit it and that it does not include confidential or sensitive information you are not authorized to share. Feedback processing is described in the Privacy Policy. You grant Phoenix Strategies a non-exclusive, worldwide, royalty-free right to use feedback to operate, improve, and support the Service, subject to the Privacy Policy.
07Service availability and changes
We may modify, update, suspend, or discontinue any part of the Service. We may update these terms by posting a revised effective date. Continued use after an update means you accept the revised terms to the extent permitted by applicable law.
08Disclaimers and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY. PHOENIX STRATEGIES DOES NOT WARRANT THAT ANY RESULT IS COMPLETE, ACCURATE, OR SUITABLE FOR YOUR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PHOENIX STRATEGIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS, INJURY, PROPERTY DAMAGE, ENVIRONMENTAL HARM, REGULATORY PENALTIES, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO THE SERVICE OR ITS RESULTS. Nothing in these terms excludes liability that cannot lawfully be excluded or limited.
